CCPA Addendum

PLEASE READ THIS CCPA ADDENDUM (“CCPA ADDENDUM”) CAREFULLY BEFORE USING THE SOFTWARE OR SERVICES OFFERED BY SHAREFUN NETWORK LIMITED (“AIHELP” OR “SERVICE PROVIDER”). THIS CCPA ADDENDUM SHALL APPLY TO THE EXTENT CUSTOMER IS A BUSINESS THAT IS SUBJECT TO THE CCPA (DEFINED BELOW). YOU OR THE ENTITY YOU REPRESENT AGREE THAT YOU HAVE READ AND ACCEPT THE TERMS IN THIS CCPA ADDENDUM, WHICH SUPPLEMENT AIHELP’S TERMS OF SERVICE AT https://www.aihelp.net/terms/ OR THE ENTERPRISE TERMS ENTERED INTO BY AND BETWEEN YOU AND AIHELP (IN EACH CASE, THE “AGREEMENT”). IF YOU ARE ACCESSING THE SERVICES ON BEHALF OF YOUR EMPLOYER, YOU REPRESENT AND WARRANT THAT YOU HAVE THE AUTHORITY TO AGREE TO THIS CCPA ADDENDUM ON ITS BEHALF AND THE RIGHT TO BIND YOUR EMPLOYER THERETO. IF EITHER YOU OR YOUR EMPLOYER DO NOT UNCONDITIONALLY AGREE TO ALL THE TERMS AND CONDITIONS OF THIS CCPA ADDENDUM, YOU HAVE NO RIGHT TO USE AIHELP’S SERVICES AND MUST NAVIGATE AWAY FROM THIS PAGE.

This CCPA Addendum supplements the Agreement only when and to the extent that a user of AIHelp’s Services provides AIHelp with personal information that is subject to the CCPA.  Any terms not defined in this CCPA Addendum shall have the meaning set forth in the Agreement. In the event of a conflict between the terms and conditions of this CCPA Addendum and the Agreement, the terms and conditions of this CCPA Addendum shall supersede and control.

The parties acknowledge and agree that AIHelp is a service provider for the purposes of the California Consumer Privacy Act (“CCPA”) and is receiving personal information from Customer pursuant to the Agreement for a business purpose. AIHelp shall not sell any such personal information. AIHelp shall not retain, use or disclose any personal information provided by Customer pursuant to the Agreement except as necessary for the specific purpose of performing the services for Customer pursuant to the Agreement, or otherwise as set forth in the Agreement or as permitted by the CCPA.  AIHelp shall, at no additional cost, provide tools and product features to Customer that are designed to assist Customer in responding to consumer requests for information, access, rectification, erasure, restriction, portability, objection, do not sell, deletion, and any other similar requests without requiring further assistance from AIHelp. The terms “personal information,” “service provider,” “sale,” and “sell” are as defined in Section 1798.140 of the CCPA. AIHelp certifies that it understands the restrictions of this paragraph.
